1 - Agreement to Terms

By accessing and using arbormantreecare.net (the “Website”) and engaging the services of Arborman Tree Care (“we,” “us,” or “our”), you (“the Client” or “User”) agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, you must refrain from using our Website or services.

2 - Privacy and Personal Data Protection

We respect your privacy and are committed to protecting your personal information. Any personal data collected through our Website, contact forms, or during the service estimation process (such as names, addresses, phone numbers, and email addresses) is used strictly for internal business operations, scheduling, and communication purposes. Arborman Tree Care will never sell, trade, rent, or otherwise share your personal data with third parties for marketing or any other unauthorized purposes.

3 - Scope of Services

Arborman Tree Care provides professional arboriculture services, including but not limited to hazardous tree removal, structural pruning, root zone excavation, air spading, and general property maintenance. All services are subject to a formal estimate and written agreement prior to the commencement of work. We reserve the right to refuse service or halt work if site conditions are deemed unsafe for our crew or equipment.

3 - Scope of Services

Arborman Tree Care provides professional arboriculture services, including but not limited to hazardous tree removal, structural pruning, root zone excavation, air spading, and general property maintenance. All services are subject to a formal estimate and written agreement prior to the commencement of work. We reserve the right to refuse service or halt work if site conditions are deemed unsafe for our crew or equipment.

4 - Insurance and Permitting

  • Insurance: Arborman Tree Care is fully licensed, bonded, and insured. We carry comprehensive general liability insurance and worker’s compensation coverage for all of our employees. Certificates of insurance are available upon request prior to the commencement of work.
  • Permits: Unless explicitly stated otherwise in the written estimate, the Client is responsible for obtaining and paying for any necessary city, county, or HOA permits required for tree removal or major arboriculture work. Arborman Tree Care will assist in providing necessary documentation but assumes no liability for work halted due to the Client’s failure to secure proper authorization.

5 - Scheduling and Extenuating Circumstances

Arborman Tree Care makes every reasonable effort to adhere to scheduled service dates. However, our operations are strictly governed by safety standards and environmental factors. In the event of inclement weather, acts of nature, or other extenuating circumstances beyond our reasonable control, Arborman Tree Care reserves the explicit right to postpone and reschedule the commencement or continuation of the scoped work. In such events, we will promptly notify the Client to arrange an alternative, mutually agreeable date for service.

6 - Stump Retention and Grinding Policies

  • Stump Retention and Height Marking: If the Client wishes to retain a stump at a specific height following a removal, the Client is strictly responsible for clearly marking the desired height using highly visible paint or rope prior to the commencement of work. In the absence of such explicit markings, our crew will default to performing a “Close Cut,” wherein the stump is reduced to the lowest possible level without risking damage to our equipment by burying the saw blades in the soil.

  • Stump Grinding and Herbicide: Stump grinding is considered a distinct service and will be billed as a separate line item on the estimate. Upon completion of a tree or shrub removal, if the Client has elected to have the resulting stump or roots ground, we will apply an herbicide treatment to the stump following the initial removal.

  • Compliance and Scheduling: To ensure safety and regulatory compliance, Arborman Tree Care will contact Digline to mark public underground utilities prior to the commencement of any stump grinding scope. Stump grinding operations are typically scheduled to occur within two (2) weeks following the initial tree removal.

  • Volunteer and Sucker Growth Mitigation: Arborman Tree Care cannot guarantee the absolute prevention of “volunteer” or “sucker” regrowth following a tree or shrub removal, or a subsequent stump grinding procedure. While we utilize standard herbicide applications in a diligent effort to mitigate such regrowth, and acknowledge that mechanical stump grinding substantially increases the likelihood of permanent mitigation, absolute prevention is not guaranteed. In the event that the Client experiences subsequent regrowth, Arborman Tree Care is committed to working collaboratively with the Client to explore viable remedial solutions.

7 - Site Conditions and Client Responsibilities

  • Property Lines: The Client is solely responsible for accurately identifying property lines. Arborman Tree Care assumes no liability for work performed on trees that cross disputed property boundaries.

  • Underground Utilities & Hazards: While our crews exercise best practices and the utmost physical caution to minimize site impact, Arborman Tree Care assumes strictly no liability for any damage to underground installations. This includes, but is not limited to, sprinkler heads, irrigation lines, underground electrical cabling, invisible fences, septic systems, or any other subterranean features. This absolute release of liability applies regardless of whether the Client has notified us of these hazards prior to the commencement of work.

  • Access: The Client agrees to provide clear access to the work site for our crew, trucks, and heavy machinery.

  • Sanitation and Biological Hazards: Prior to the commencement of any scoped work, the Client is strictly required to ensure that all designated work areas and access points are entirely free and clear of animal feces. Such biological waste poses a direct health and safety risk to our personnel. In the event that our crew arrives and the site has not been adequately cleared, a mandatory $250.00 sanitation and cleanup fee will be automatically added to the Client’s final invoice to safely address the hazard before work can proceed.

8 - Payment Terms, Deposits, and Cancellations

  • Accepted Methods and Surcharges: We accept multiple forms of payment, including cash, check, major credit/debit cards, PayPal, Zelle, CashApp, Square, and Venmo. Please be advised that any payment remitted via methods other than cash or check will be subject to a 3% surcharge to cover standard banking and processing fees.

  • Payment Due: Payment in full is due immediately upon the completion of the scoped and approved work as illustrated on the Client’s estimate. For stump grinding, payment is due in full immediately upon the completion of that specific separate line item.

  • Deposits: For projects with an estimated total exceeding $3,000, a 50% upfront deposit is required prior to scheduling and commencement of work. This deposit is strictly 100% non-refundable. The remaining 50% balance will be due upon the completion of the scoped services.

  • Cancellations: Scheduling our crews and equipment requires significant logistical planning. Therefore, once an estimate is formally approved and the project is scheduled, any cancellation by the Client will incur a cancellation fee equal to 20% of the total scoped services.

9 - Default and Non-Payment

  • Default and Late Fees: In the event that an invoice remains unpaid beyond the specified due date, Arborman Tree Care reserves the right to assess a late fee of 1.5% per month (18% annually) on the outstanding balance, or the maximum rate permitted by Idaho law, whichever is lower.

  • Collections and Liens: The Client agrees to pay all reasonable costs of collection, including but not limited to collection agency fees, attorney fees, and court costs incurred by Arborman Tree Care in the event of non-payment. Furthermore, Arborman Tree Care reserves the right to file a mechanic’s lien against the serviced property for any unpaid labor and materials in accordance with Idaho state law.

10 - Limitation of Liability

Arborman Tree Care takes every precaution to execute our work safely and professionally, with the utmost respect for your property, striving to leave the yard in a better condition than when we arrived. However, tree care inherently involves heavy materials, large equipment, and the unpredictable nature of felling timber.

  • Heavy Machinery: We are not liable for unavoidable minor damage to lawns, driveways, or sidewalks caused by the necessary use of heavy machinery (such as bucket trucks, chippers, or skid steers) required to safely complete the job.

  • Movable Property and Hardscaping: The Client is responsible for securing or relocating movable property. We assume strictly no liability for incidental damage to fences, yard art, outdoor decor, or related items that have not been clearly and entirely removed from the designated work zone prior to the commencement of services.

  • Surrounding Landscaping: While our crews exercise extreme caution to protect the surrounding landscape, we assume no liability for unavoidable minor damage to neighboring trees, shrubs, or flowering plants situated in close proximity to the active work zone or access paths.

  • Natural Events: We are not responsible for damages resulting from acts of God, preexisting structural weakness in trees, or unforeseeable weather events during or after our services.

  • Liability Cap: In no event shall Arborman Tree Care’s total liability to the Client exceed the total amount paid by the Client for the specific service in dispute.

11 - Client Satisfaction and Dispute Resolution

Arborman Tree Care is dedicated to delivering exceptional service, and our primary objective is the complete satisfaction of our clients upon the execution of the scoped work. In the event that the Client is unsatisfied with the completed scope of work, or wishes to address a formal complaint, we cordially ask that the Client contact our office directly by phone to seek a prompt and amicable resolution. Should the Client be unable to reach us by phone, they are instructed to direct their correspondence via email to Arborman.jessica@gmail.com. We are fully committed to working collaboratively with our clients to address and resolve any concerns.

12 - Intellectual Property

All content, logos, graphics, and text on this Website are the exclusive property of Arborman Tree Care. Unauthorized use, reproduction, or distribution of this material without prior written consent is strictly prohibited.

13 - Severability

If any provision of these Terms and Conditions is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.

14 - Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Idaho. Any disputes arising from these terms or our services shall be resolved in the appropriate courts located in Idaho.

15 - Modifications to Terms

We reserve the right to update or modify these Terms and Conditions at any time without prior notice. Continued use of our Website or services following any changes constitutes your acceptance of the revised terms.
